Who Can Qualify?

The EB-5 Immigrant Investor Program Is Open to Foreign Nationals who are able to make a qualifying investment using lawfully sourced funds. In most cases, an investment of $800,000 in a qualifying EB-5 project located in a Targeted Employment Area (TEA) is sufficient to meet the program’s investment requirement. There are no nationality restrictions, although visa availability and processing timelines may vary by country of birth.

EB-5 does not require investors to secure employment, operate a business, pass an English-language test, or meet minimum education or management experience standards. Investors are not required to live near or participate in the day-to-day operations of the project, and they may live, work, or retire anywhere in the United States, regardless of where the EB-5 investment is located.

A single qualifying EB-5 investment may cover the principal applicant, their spouse, and any unmarried children under the age of 21, all of whom may obtain permanent residence together through the same application. As with all EB-5 cases, eligibility is subject to meeting USCIS requirements and successful petition approval.
