The investor selects an EB-5-qualifying project and reviews offering documents, including business plans, economic reports, and risk disclosures.
This is a critical step. Not all EB-5 projects are structured the same, and immigration eligibility does not equate to investment quality.
USCIS review times vary and can be lengthy.
If the I-526E is approved and a visa is available, the investor and qualifying family members receive conditional permanent residence valid for two years.
At this stage, the investor must remain invested, and the project must move forward as planned.
Near the end of the two-year conditional period, the investor files Form I-829.
